The website www.mapurbex.com is published by WAYPOINT GROUP. It offers for sale digital files containing GPS coordinates of places whose visual, historical, or contextual aspects suggest abandonment or disuse, for informational, cultural, and documentary purposes only.

By purchasing a product on our site, you fully and unreservedly accept these Terms and Conditions, which govern the entire contractual relationship between MapUrbex and you as a customer or user.

Please read all of the articles below carefully before making any purchase or browsing our site.

PRELIMINARY WARNING

MapUrbex does not condone or encourage breaking the law, particularly with regard to private property. Access to the referenced locations remains the sole responsibility of the user, who agrees to comply with applicable laws.

The User acknowledges that the GPS coordinates, information, descriptions or content made available are purely informative and in no way constitute an authorization to access, enter, visit or explore a location.

Before any visit or attempt to access a location identified in particular by means of GPS coordinates, it is exclusively for the User to find out about the laws, regulations, orders, local rules and rights applicable in the country, region or locality concerned, as well as about the legal status of the land, building or site.

The User is informed in particular that, depending on the countries and locations concerned, legal or regulatory provisions may limit, make subject to authorization, restrict or prohibit access to certain sites, including where they appear abandoned, unoccupied, disused or freely accessible. The apparent abandonment of a location may under no circumstances be interpreted as the absence of an owner, the absence of regulation or an authorization to enter it.

The User remains solely responsible for complying with all applicable rules, in particular regarding private property, trespassing, heritage protection, safety, environmental protection or any other local regulation. It is also for the User to obtain, where applicable, the necessary authorizations before any access or visit.

Consequently, the User acknowledges using the information and coordinates provided under their sole responsibility and undertakes not to regard their provision as an incitement or an authorization to access a location in breach of the applicable laws, regulations, prohibitions or rights.

Where a location is situated in France, the User is informed that Article 9 of the French Civil Code enshrines everyone's right to respect for their private life. Consequently, the fact that a location appears abandoned, unoccupied or disused does not release the User from respecting the rights of the persons who may be concerned by the information, documents, personal effects or other items present at the location.

The User acknowledges in particular that they must exercise vigilance before taking, recording, reproducing, distributing or publishing photographs or videos likely to reveal personal information, elements relating to a person's private life or any other content whose capture or distribution would be likely to infringe the rights of a third party. The User alone assumes responsibility for the images, recordings and publications they make and, more generally, for the civil or criminal consequences that may result from an infringement of the rights of the persons concerned.

The User is also informed that certain capture or recording behaviours infringing the privacy of private life may, depending on the circumstances, fall under the applicable criminal provisions, in particular Article 226-1 of the French Penal Code.

Furthermore, the User is expressly warned that Article 226-4 of the French Penal Code punishes entry into another person's home when carried out, outside the cases provided for by law, by means of manoeuvres, threats, assault or coercion, as well as remaining in such a home following such entry. These acts are currently punishable by three years' imprisonment and a fine of 45,000 euros.

Within the meaning of that provision, a home may in particular be a dwelling containing movable property belonging to a person, including where that person does not live there or where it is not their main residence.

The User accordingly acknowledges that it is for them, before any access to a location situated in France, to verify its legal nature, its status, any occupancy, and the authorizations required to access it. The apparent abandonment, vacancy or free accessibility of a building or land does not, by itself, constitute an authorization to enter it or a guarantee as to the absence of an offence or of liability.

The provision of GPS coordinates or of any other information relating to a location may not be interpreted as an authorization to access, an incitement to enter a private or protected place, or a guarantee of the lawfulness of the images or recordings that may be made there. The User remains solely responsible for complying with the applicable legal and regulatory provisions and with the rights of third parties.

ARTICLE 1 – PURPOSE AND SCOPE

These Terms and Conditions apply without restriction or reservation to all sales concluded by the publisher of www.mapurbex.com with consumers or non-professional buyers.

MapUrbex sells GPS coordinates of potentially abandoned places in the form of digital files (PDF, KML, KMZ, or interactive links) intended for consultation, personal research, or historical documentation purposes.

The Customer acknowledges having full legal capacity to contract and declares having read and accepted these ToS prior to any purchase. Any order on the site constitutes express and irrevocable acceptance of these conditions.

ARTICLE 2 – TERMS OF USE

By using www.mapurbex.com and placing an order, the Customer or User expressly accepts these Terms of Use of the site.

2.1 – Age and Legal Capacity

  • have reached the legal age of majority in their country of residence;
  • be legally capable of entering into a contract;
  • use the products only for personal, non-commercial, and lawful purposes.

2.2 – Access and Conduct on the Site

Access to the site is free. The user agrees to:

  • not use the site for fraudulent, illegal, or ToS‑violating purposes;
  • not disrupt the proper functioning of the site (hacking attempts, overload, virus distribution, etc.);
  • respect MapUrbex's intellectual property rights.

MapUrbex reserves the right to suspend or block access to the site for any user in the event of a clear violation of these terms.

2.3 – Nature of the Data Provided

The Customer is informed that:

  • the locations listed on www.mapurbex.com are not open to the public,
  • their access may require authorization from the owner or authorities,
  • the GPS coordinates provided may concern locations outside France, subject to different local regulations.

MapUrbex does not condone or encourage trespassing. The Customer is solely responsible for any offense or legal consequence related to the use of the purchased coordinates.

2.4 – Personal Data

The Customer is invited to consult our Privacy Policy, which governs the collection, processing, and storage of personal data in accordance with the GDPR.

ARTICLE 3 – ORDER

The ordering process includes:

  1. Selection of locations or GPS coordinate packs.
  2. Access to cart and order summary.
  3. Entry of personal information (name, email).
  4. Acceptance of the ToS via a required checkbox.
  5. Secure payment via Stripe (Apple Pay, Google Pay, and more).
  6. Receipt of a confirmation email containing the product (or download link).

The order is considered final upon receipt of payment.

No order will be processed without express acceptance of these ToS.

ARTICLE 4 – PRICES AND PAYMENT

Prices displayed on the site are in euros, all taxes included (TTC).

MapUrbex accepts the following payment methods:

  • Credit card, Apple Pay, Google Pay (via Stripe – SSL / PCI-DSS)

Payment is due immediately upon ordering.

Products remain the property of MapUrbex until full payment is received.

An invoice can be sent by email upon request.

ARTICLE 4 BIS – PRICE CHANGES

MapUrbex reserves the right to change its prices at any time without notice.

Products are billed based on the rates in effect at the time the Customer confirms the order.

In case of a clear pricing error (derisory or inconsistent price), MapUrbex reserves the right to cancel the order, even after confirmation, without compensation.

ARTICLE 5 – NO RIGHT OF WITHDRAWAL

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content provided without a material medium, once performance has begun with the consumer's express consent.

By confirming the order, the Customer:

  • expressly agrees to the immediate provision of the digital content;
  • waives their right of withdrawal.

Therefore, no refunds are possible after the order is confirmed.

ARTICLE 6 – EXCEPTIONAL REFUND POLICY

As a commercial gesture, MapUrbex may offer a complimentary exchange if a location proves to be:

  • demolished, rehabilitated, or permanently inhabited,

upon submission of a dated photo to contact@mapurbex.com.

Compensation offered: 2 locations provided for 1 location that became unusable.

This goodwill replacement policy applies once per customer, except in exceptional cases. MapUrbex reserves the right to refuse repeated or abusive requests.

Should a location whose GPS coordinates have been ordered by the Customer prove impracticable or inaccessible for any reason whatsoever, in particular because of its destruction, its closure, works, a change in access conditions, a particular danger or any other circumstance reasonably preventing its visit, MapUrbex undertakes, by way of compensation, to offer the Customer the GPS coordinates of two other locations, after the Customer has evidenced the impossibility of visiting the location ordered, in particular by sending photographs or videos to contact@mapurbex.com.

MapUrbex may refuse this compensation if the reasons are not sufficiently legitimate.

The two locations offered as compensation are selected exclusively by the Seller, at its sole discretion and depending in particular on the locations available in its catalogue or on its knowledge at the time of the request.

The Customer expressly acknowledges and accepts that they have no right to choose, designate or demand specific locations as compensation. In particular, the Customer may not request that the locations offered be replaced by other coordinates of their choice, nor demand compensation corresponding to the value of locations they would have selected themselves.

The provision of the GPS coordinates of these two locations constitutes the compensation offered by the Seller for the impracticability or inaccessibility of the location initially ordered. Subject to the applicable mandatory legal provisions, this compensation gives rise to no refund, additional indemnity, credit note or other financial consideration.

The Customer remains required to verify, before any attempted visit, the access conditions, the practicability of the location, any necessary authorizations and compliance with the applicable laws and regulations.

ARTICLE 7 – DELIVERY OF PRODUCTS

Products are delivered by email immediately after payment, in the form of:

  • hyperlink,
  • PDF file,
  • or KML/KMZ file.

If not received within 24 hours, the Customer should check their spam folder or contact support.

ARTICLE 7 BIS – DATA UPDATES AND ACCURACY

Files provided by MapUrbex are for informational purposes, based on knowledge available at the time of publication.

MapUrbex does not guarantee the accuracy, completeness, or real-time updating of the provided geographic data.

Some coordinates may no longer be valid or may change due to factors beyond MapUrbex's control (demolition, rehabilitation, access closure, etc.).

No claims or refund requests may be based solely on the obsolescence of a location, except under Article 6.

ARTICLE 8 – LIABILITY AND LIMITATIONS

8.1 – Nature of the Data Provided

MapUrbex acts as a research facilitator.

The files sold contain GPS coordinates for strictly informational, historical, and documentary purposes.

They are provided without any guarantee regarding:

  • physical accessibility of locations,
  • their state of conservation or abandonment,
  • their legal status (public/private),
  • their safety or hazardousness.

Under no circumstances does this information constitute an incitement, recommendation, or authorization to enter derelict, prohibited, or private locations.

The Customer is referred to the preliminary warning set out in the preamble to these general conditions for a more exhaustive caution.

8.2 – User Responsibility

The Customer acknowledges the inherent risks of urban exploration (Urbex), including but not limited to:

  • falls, injuries, health hazards,
  • presence of third parties, animals, toxic or unstable substances,
  • legal consequences (offense, arrest, prosecution, etc.).

The user is solely responsible for their actions. It is their responsibility to verify, before any physical approach, the legality of access to the location and to comply with the laws in force in the relevant country or region.

The Customer acknowledges that the order and the provision of GPS coordinates have the sole purpose of communicating the location of a place and constitute neither an invitation, nor a recommendation, nor a guarantee as to the conditions of access, safety, state, practicability or compliance of the location concerned.

Any decision to go to a location whose GPS coordinates have been ordered on the Site is the sole initiative and sole responsibility of the Customer. It is for the Customer in particular to verify, before and during their visit, the conditions of access to the location, the possible risks, the state of the buildings, land or infrastructure, as well as compliance with the applicable authorizations, prohibitions, safety rules and legal and regulatory provisions.

Consequently, the Customer alone assumes the risks related to their decision to visit or attempt to access a location whose GPS coordinates were obtained through the Site.

8.3 – Access Prohibited Without Authorization

Exploration or entry onto private property, even if abandoned, without explicit consent from the owner or competent authority, is prohibited by French law under the conditions set out in Articles 226-4 and 226-4-3 of the French Penal Code.

MapUrbex strongly discourages any attempt to access a location without legal authorization.

The Customer is expressly encouraged to:

  • learn about the legal status of the location,
  • contact the owner or municipality where possible,
  • refrain in case of doubt.

MapUrbex warns the User of the prohibition laid down in Article 226-4-2-1 of the French Penal Code, which punishes conduct consisting in carrying out any propaganda or advertising, whatever the means, in favour of methods intended to facilitate or incite the commission of an offence provided for in Articles 226-4 and 315-1 of the French Penal Code.

8.4 – Disclaimer of Liability

MapUrbex disclaims all liability in the event of:

  • bodily injury or material damage,
  • injuries, losses, or accidents,
  • offenses, arrests, or legal proceedings,
  • or any consequence directly or indirectly related to the use of the transmitted files, even partially.

Subject to the applicable mandatory legal provisions, MapUrbex may not be held liable for accidents, bodily, material or immaterial damage, nor for direct or indirect harm suffered by the Customer or by any third party during or following the visit to, the attempted access to, or the access to such a location.

The Customer may not seek to hold MapUrbex liable and may not claim any indemnity, refund or reparation for damage or harm resulting from an accident or an event occurring during the visit or attempted visit to a location whose GPS coordinates were ordered on the Site.

Likewise, in the event of a claim, demand, formal notice, request for compensation, administrative proceeding or legal action brought in particular by the owner, the occupier or any other holder of rights over the visited location, and resulting directly or indirectly from the Customer's decision to go to that location, to access it, to attempt to access it or to carry out any activity there, the Customer may not seek the Seller's guarantee, liability or intervention.

In particular, the Customer may not require MapUrbex to conduct their defence, to bear the financial consequences of such a claim or proceeding, or to reimburse the costs, convictions, indemnities, damages, expenses or other sums that may be charged to them, where these result from their own acts, their conduct or their decision to visit or attempt to visit the location concerned.

8.5 – International Use

Some files may concern locations outside France.

It is the user's responsibility to check local laws before using the data.

MapUrbex cannot be held responsible for offenses or incidents abroad resulting from the use of its services.

ARTICLE 8 BIS – RIGHT TO REMOVAL OF INFORMATION

Any natural or legal person who believes that a listed location is on their private property, or that it infringes their privacy, may request the immediate removal of their data.

Requests must be sent to contact@mapurbex.com specifying the location concerned, proof of ownership, and the reasons for removal.

MapUrbex undertakes to process any request within a maximum of 5 business days. In case of doubt or dispute, MapUrbex may proceed with a preventive removal without admission of liability.

ARTICLE 9 – PAYMENT SECURITY

All transactions are secured via:

  • SSL encryption,
  • 3D Secure protection,
  • external processing by Stripe.

ARTICLE 9 – FRAUD

In case of suspected fraud, MapUrbex reserves the right to:

  • refuse or cancel an order,
  • request identity verification.

ARTICLE 10 – PROHIBITED USES

It is strictly prohibited:

  • to reproduce, resell, or distribute the files or coordinates sold.
  • to use the information for illegal, discriminatory, or malicious purposes.
  • to transmit viruses or interfere with the proper functioning of the site.
  • to use a robot, software, or automatic device to systematically collect, copy, or extract data from the site or MapUrbex files for reproduction, resale, or analysis;
  • to train any artificial intelligence or data processing system using MapUrbex content.

MapUrbex files may contain invisible digital fingerprints or discreet identifiers, allowing us to trace their origin in the event of unauthorized distribution.

Any resale, sharing or republication of purchased files, even free of charge, may give rise to proceedings for infringement, unfair competition or any other relevant basis of tortious or contractual civil liability.

ARTICLE 11 – INTELLECTUAL PROPERTY

All content on the site (texts, maps, coordinates, images, structures) is protected by intellectual property laws.

Any reproduction or reuse without written authorization is subject to civil and criminal penalties (infringement, parasitism, unfair competition, etc.).

ARTICLE 12 – DISPUTES AND MEDIATION

In the event of a dispute relating to the performance of this contract, the consumer must first send a written complaint to the professional: WAYPOINT GROUP, 149 avenue du Maine, 75014 Paris — contact@mapurbex.com.

If this complaint does not lead to an amicable solution, the consumer may refer the matter free of charge to the consumer mediator to whom the professional is affiliated, in accordance with Article L612-1 of the French Consumer Code. The contact details of the competent mediator are provided on request at contact@mapurbex.com.

The mediator may be referred to in accordance with the procedures set out on their website.

Recourse to mediation is optional. Each party remains free to accept or refuse the solution proposed by the mediator and retains the right to bring the matter before the competent court.

ARTICLE 13 – CHANGES TO THE ToS AND FORCE MAJEURE

MapUrbex reserves the right to modify these ToS at any time.

The applicable version is the one in force at the time of ordering.

In the event of force majeure (pandemic, war, natural disaster, strike, server outage, unavailability of payment services, etc.), contractual obligations may be suspended or canceled without compensation. MapUrbex will inform the customer as soon as possible and propose any reasonable solution to mitigate consequences.
